"Market research surveys commissioned by one of the nation’s largest environmentalist groups advises activists to “talk about yourselves as conservationists — not environmentalists,” “do not make global warming/climate change the primary rationale for conservation,” “do not use the threat of ‘sprawl’ unless with core supporters,” and “do not focus on ‘green’ jobs as a primary rationale for conservation.”
...These same companies were used recently to provide a dubious and nontransparent poll claiming a majority of "Michigan’s business leaders” support President Barack Obama’s proposed Clean Power Plan.
The reports include comments such as “scientists clearly link global warming to increasingly extreme weather events.” Such unqualified statements reveal the point of view of the researchers, which is expressed along with the findings of their research.
Here are a few excerpts from the documents:
From the 2004 document — “Do talk about yourselves as ‘conservationists’ — not ‘environmentalists.’  This bears repeating. Voters are more likely to view themselves as ‘conservationists’ than ‘environmentalists.’ Moreover, in the focus groups, there was a decided skepticism about the agendas of some ‘environmental groups’ who engage in land preservation.”
From the 2013 document — “Do not make global warming/climate change the primary rationale for conservation. While scientists clearly link global warming to increasingly extreme weather events that affect the safety of people and communities, it is not yet perceived similarly by the public. The most politically polarizing rationales for conservation are those that position climate change as the primary reason for engaging in conservation. Republicans and Independents rated these messages significantly lower than other rationales in support of conservation.”
“However, referring to climate change in passing as part of a broader argument for conservation has generally not had a significant impact — positive or negative — on responses. In the interest of continuing to expand and reinforce public attention to this vital issue, incorporating subtle references to climate change into otherwise strong messages may be advisable. This, however, is an area where location specific research is likely critical.”
From the 2004 document, and stressed again in the 2013 document — “Do talk about water first and foremost. Water cannot be stressed enough, and really it doesn’t matter how you say it. In fact, voters prioritize water as a critical reason to purchase and protect land, no matter how it is expressed: vast majorities of those polled see it as ‘very important’ to buy land to protect drinking water quality (84 percent); improve the water quality in our lakes, streams and rivers (75 percent); protect lakes, rivers and streams (72 percent); and protect watersheds (66 percent).”
“Moreover, water is tops in every region (not just the perennially thirsty West) and rates just as high in big cities (85 percent very important) as rural areas (84 percent). Most importantly, this data substantiates one of the things we heard in focus groups throughout the West — voters closely link land conservation with protecting water.”
2013 — “Do turn voters’ views of a tough Mother Nature to your advantage — by showing how conservation of critical natural defenses keeps communities safe. Whether wildfire, flooding, or hurricanes, voters tend to think of nature as being a force with which to be reckoned. That ‘one tough lady’ image can pose problems — the concept of ‘resilience’ actually serves to make voters less likely to feel we need to engage in restoration projects in recent focus groups along the Gulf Coast — but can also be an advantage. The idea that ‘natural defenses’ can serve as flood controls or storm-barriers is credible and resonates from Louisiana to North Dakota.”
2013 — “Do not count on public support for conservation unless you work to make it happen. Conservation is less of a concern today than in the recent past; economic issues have pushed it further down the list of most pressing concerns in voters’ minds. While voters value land, water and wildlife and want to conserve them, issues related to conservation simply are not everyday concerns for them. In recent research in six western states, we found that a majority (54 percent) admitted they had no idea of the position their Member of Congress has taken on protecting land and water.”
2013 — “Do not focus on ‘green’ jobs as a primary rationale for conservation. While the economy still tops voters’ priorities in our own polling, voters continue to find other traditional aspirational rationales for conservation more resonant — like leaving a legacy for future generations and protecting sources of clean air and water. In addition, some of the language used to describe these jobs can be off putting. Many do not understand the term ‘sustainable’ for instance. Similarly, many voters are tired of the term ‘green.’”...

Solyndra Executives Misled Federal Officials, Investigators Find | Somewhat Reasonable
President Obama committed, Monday, to financing a new generation of “alternative energy” industrialists under his Clean Power Plan, but one of the original Department of Energy program loan recipients, solar power company Solyndra, reportedly misled DOE officials in pursuit of government money, a federal investigators report has found.
According to the Energy Department’s Inspector General, who conducted a four-year investigation alongside the FBI, while Solyndra claimed that they had a guaranteed $2.2 billion in firm contracts for their innovative, cylindrical solar panels, Solyndra had quietly offered secret discounts to all of its customers, many of whom never made good on their full contracts.
According to the Washington Post:
Solyndra’s leaders engaged in a “pattern of false and misleading assertions” that drew a rosy picture of their company enjoying robust sales while they lobbied to win the first clean energy loan the new administration awarded in 2009, a lengthy investigation uncovered. The Silicon Valley start-up’s dramatic rise and then collapse into bankruptcy two years later became a rallying cry for critics of President Obama’s signature program to create jobs by injecting billions of dollars into clean energy firms…
Solyndra officials told the government in 2009, for example, that they had firm contracts to sell $2.2 billion worth of their unique cylindrical solar panels over the next five years. But behind the scenes, investigators found, Solyndra was struggling with customers who were balking at the high panel prices, arranging secret side deals to pay discounted prices and refusing to buy as many panels as they once promised.
In addition, investigators discovered that Department of Energy employees, in charge of reviewing Solyndra’s loan application, felt “pressure” from inside the Administration to approve the Solyndra loan, and so overlooked many of the warning bells in the application’s finer print.
If you recall, in one of his first acts in office, President Obama approved a whopping $787 billion federal stimulus program, part of which would be dedicated to funding upstart alternative energy companies. The Department of Energy was responsible for overseeing these loans, and many of the loans were awarded to major campaign donors and bundlers, rather than to deserving alternative energy programs. According to Peter Schweizer, $16.4 billion of the $20 billion in DOE loans granted went to “companies either run by or primarily owned by Obama backers,” members of his finance committee and Democratic National Committee mega-donors. The program itself was run by Steve Spinner, a major Obama donor and finance committee member who “happened” to join the DOE as their “chief strategic operations officer” after Obama’s 2008 campaign. Spinner was ultimately put in charge of the alternative energy loan program.
...After Solyndra finally collapsed and shut its doors, the Administration and friendly Democrats in Congress were quick to deny any wrongdoing in the DOE loan process, blaming Solyndra’s abysmal failure on the economic downturn, and reassuring now skeptical taxpayers that Solyndra had at least created a “ripple” effect, sparking other solar energy companies to take on new and innovated processes. Taxpayers were left on the hook for about $527 million of the $535 million loan – but George Kaiser, whose investment company’s claim was ahead of the Federal government’s in the bankruptcy process, managed to recover most of their investment from auctioned assets, leaving nothing for taxpayers or the DOE to recover for their loans.
...So far, the Department of Justice, despite seemingly having enough evidence to pursue a case in Califrnia, has so far declined to press charges for fraud against Solyndra and its executives. The Inspector General plans to press DOJ officials to take a second look at the case."

Maverick researchers have long argued that much of what gets published in elite scientific journals is fundamentally squishy — that the results tell a great story but can’t be reproduced when the experiments are run a second time.

Now a volunteer army of fact-checkers has published a new report that affirms that the skepticism was warranted. Over the course of four years, 270 researchers attempted to reproduce the results of 100 experiments that had been published in three prestigious psychology journals.
It was awfully hard. They ultimately concluded that they’d succeeded just 39 times.
The failure rate surprised even the leaders of the project, who had guessed that perhaps half the results wouldn’t be reproduced...

Not so for the Los Angeles County Board of Supervisors.
The majority of the supervisors wash their take-home cars two or three times a week, service records show, and actually washed them more frequently after Gov. Jerry Brown ordered a 25 percent cut in urban water use. 
As the county’s washes continue to consume tap water, some other local governments have pledged to skip washes for months or are using recirculated water.

A New Jersey teacher will keep his job even though he was late for work 111 times over a two-year period.  
An arbitrator criticized Arnold Anderson's claim that the quality of his teaching outweighed his tardiness.
However, the arbitrator found the city of New Brunswick School District failed to give him adequate notice to correct his behavior and the 15-year classroom veteran is entitled to progressive discipline prior to termination.
According to the arbitrator, the Roosevelt School Principal meticulously tracked Anderson's "cascades of tardiness", and said that none were plausibly explained.
The arbitrator's decision stated:  "At most, Respondent uses micro-quibbles of a few unpersuasive explanations, with a macro-default position that even when he is late he nevertheless delivers a superb educational experience to his grateful students."
The arbitrator, David L. Gregory, ruled that despite Anderson not having credible explanations for his tardiness, he is entitled to "due process and fundamental fairness."
Gregory then stated that Anderson should be allowed to return to work in full pay status on the first day of scheduled classes following January 1, 2016.

Whitehurst’s father was not pleased.

“A bunch of hoodlums that are throwing their lives away punched my son from behind who is serving his country and has his stuff together,” he said to reporters.
He added, “I just drove my son home who has his jaw wired shut, and a mandible fracture in two with a plate and his jaw wired shut, and he threw up on the way home with his mouth shut.”

What happened to Matthew Whitehurst is truly sickening, not that “Black Lives Matter” activists care. "

A little more than a year ago, oil prices were above $100 a barrel.
The national average for gasoline was in the $3.50 range.
In late spring, oil was $60ish and the national average for gas was around $2.70.
The price of a barrel of oil has plunged to $40 and below—yet, prices at the pump are just slightly less than they were when oil was almost double what it is today.
Oil and gasoline prices usually travel up or down in sync.
But a few weeks ago the trend lines crossed and oil continued the sharp decline while gasoline has stayed steady—even increasing.
Oil’s down, gasoline isn’t.
Consumers are wondering: “What’s up?”
...The short explanation is “refineries”—but there’s more to that and some other components, too.
Within the U.S. exists approximately 20 percent of the world’s refining capacity.
...But due, in large part, to an anti-fossil fuel attitude, it is virtually impossible to get a new refinery permitted in America. 
Most refineries today are old—the newest major one was completed in 1977. 
Most are at least 40 years old and some are more than 100.
Despite signs of aging, refining capacity has continued to grow.
Instead of producing at 70 percent capacity, as they were as little as a decade ago, most now run at 90 percent.

It has become such a cliché that the civics class rendition of how a bill becomes law bears only superficial resemblance to real legislative practice that even Saturday Night Live is in on the joke (after you’ve watched that clip, see our executive orders chart). 
The lawmaking process does not end with the president’s signature, contrary to the tidy story presented in civics books. 
Instead, the passage of the law might well be considered the foundation, not the end of lawmaking. 
The Federal Food, Drug, and Cosmetic Act (FDCA) vividly demonstrates the point. 
The FDCA, which President Franklin Roosevelt signed into law in 1938, revamped the legal authority for the Food and Drug Administration (FDA). 
In the nearly 80 years since, the FDA has built on the foundation of the FDCA and its amendments a tower of regulations, each of which has the force of law.
With RegData, we can size up this accumulation of regulatory law. 
RegData counts the number of words and individual regulatory restrictions—words and phrases that identify a specific mandatory or prohibited activity—in each part-level division of the Code of Federal Regulations (CFR). 
...The (1938) FDCA itself was 19 pages long and contained about 11,700 words, as printed in the United States Statues at Large. 
In the 2014 edition of the CFR, the regulations associated with the FDCA comprised about 2,180,000 words. 
About 130,000 new words were added in the previous ten years..."

"President Barack Obama warned Republicans in Congress against threatening a government shutdown after returning from their break in September – at which point they will have a month to pass a new federal budget.

“Let’s not introduce unrelated partisan issues,” Obama said Thursday in New Orleans, where he spoke to commemorate the 10th anniversary of Hurricane Katrina. “Nobody gets to hold the American economy hostage over their own ideological demands.”

 "The Mexican government is warning that Texas’ denial of birth certificates for U.S. children born here to undocumented immigrants stands to imperil the relationship between Mexico and the Lone Star State.
The concern was raised in an amicus brief filed Monday evening to lend support to immigrants parents who sued Texas after being denied birth certificates for their U.S.-born children, even after showing their “matrículas,” the ID cards issued by the Mexican consulate to undocumented immigrants.
Mexico says the practice stands in stark contrast to the historical practice among countries to accept passports or other forms of ID to issue birth certificates.
[It] not only jeopardizes their dignity and well-being, but could threaten the unique relationship between Mexico and Texas, the Mexican government said in a brief tied to a lawsuit filed against the state by Texas Civil Rights Project and Texas Rio Grande Legal Aid..."

Texas Top Destination for Migrating Taxpayers in 2013, New York Biggest Loser:
"Texas was the top destination for American taxpayers on the move between 2012 and 2013, with 152,477 people moving to the Lone Star State from other parts of the country.
Texas’ in-country migrants accounted for “more than half of the net migration into the South,” according to a report released last week by the Internal Revenue Service (IRS).
In contrast, New York lost the largest number of taxpayers during that same time period, with 113,861 taxpaying residents leaving the Empire State.
“New York made up more than half of the net loss from the Northeast,” the IRS reported, noting that the “data do not represent the full U.S. population because many individuals are not required to file an individual income tax return.”"

Liberals love the idea of the minimum wage and a “living wage”…at least until it hits their bottom line.
Lanesplitter Pizza & Pub in Emeryville, California is learning that economics lesson the hard way.
Cities up and down California have been considering hiking up their minimum wage so Vic Gumper, the owner of Lanesplitter, decided to get ahead of the curve and do it on his own.
Rather than just raise the minimum wage for his employees, he decided to do it in the form of creating a “living wage pizza.”
This business model means that all workers now earn $15 to $25 an hour as part of an experimental business model that also did away with gratuities and raised prices, making meals at all five locations “sustainably served, really … no tips necessary,” the Los Angeles Times reported.
“This movement, it’s going on everywhere,” Gumper told the paper.
“We just decided to manage the situation and get to a place where we can sustain it.”
But while patrons have applauded the move verbally, they haven’t put their money where their mouth is.
The “living wage pizza” costs more than $30 and people haven’t been too keen on paying for it.
Gumper has seen a 25% drop in sales since April and has had to eliminate lunch hours at a few of his locations, according to the L.A. Times.
“The necessity of paying people a living wage in the Bay Area is clear, so it’s hard to argue against it, and it’s something I’m really proud to be able to try doing,” he said.
“At the same time, I’m terrified of going out of business after 18 years.”
