As Sanchez notes, it's not just whether or not any of us are direct targets, but the overall chilling effects of how the system is used. 
And, I should note, that while Wittes is confident that he's safe -- there are a growing number of folks who have good reason to believe that they are not immune from such surveillance. 
The recent revelation that Tor users are labeled as extremists who get extra-special scrutiny seems like a major concern. 
Similarly, the story from earlier this year that the NSA targeted the Pirate Bay and Wikileaks as part of some of its surveillance efforts is a major concern. 
In the process of doing journalism, I've communicated with folks associated with some of those and other similar organizations. 
In the past, I probably would have similarly noted that I doubted the NSA cared at all about what I was doing, but as each of these stories comes out, I am increasingly less sure. 
And, more importantly, even if the NSA is not at all concerned with what I happen to be doing, just the fact that I now have to think about what it means if they might be certainly creates a chilling effect, and makes me think twice over certain people I contact, and what I say to them. 

It's easy to claim that you're not worried when you're the one out there supporting those in power. It becomes a lot trickier when you're either criticizing those in power, or communicating with those who challenge the power structure. 

Suddenly, it's not so easy to sit on the sidelines and say "Meh, no one's going to care about me..." 
And that should be a major concern. 
The way we keep a strong democracy is by having people who are able and willing to challenge the status quo and those in power. 
And yes, the US is much more forgiving than many, many other countries to such people, but there are clear biases and clear cases where they are not at all accepting of such things. 
And the more of a chilling effect the government creates around those things, the more dangerous it becomes to stand up for what you believe in.

Kaylene Mann's brother Rod Burrows and sister-in-law Mary Burrows were on board Flight 370 when it vanished in March. On Friday, Mann found out that her stepdaughter, Maree Rizk, was killed along with 297 others on Malaysia Airlines Flight 17, which U.S. intelligence authorities believe was shot down by a surface-to-air missile.
"It's just brought everyone, everything back," said Greg Burrows, Mann's brother. "It's just ... ripped our guts again."
Burrows said his family was struggling to understand how they could be struck by such horrible luck on two separate occasions with the same airline.

But sadly, our public lands are under attack -- and by members of Roosevelt's own party.
Last year, Sen. Tom Coburn (R-Okla.) penned a report blasting Michigan's Isle Royale National Park and others as exemplifying the "more egregious, wasteful or otherwise questionable expenses." 
The sequestration's budget cuts cost the national parks almost $200 million -- which meant closed restrooms and campsites.
And Republicans scapegoated park rangers when they shut down the government last fall, thus closing national parks and monuments like the hallowed World War II memorial in Washington, D.C.
This year, the GOP-controlled House passed a bill gutting the Antiquities Act -- one of Roosevelt's signature achievements -- which paved the way for Olympic National Park, the Grand Canyon and other gems.
Now presidential hopeful U.S. Sen. Ted Cruz (R-Texas) is on the warpath against the national parks. 
This month, he slipped in a little-known amendment to the Bipartisan Sportsmen's Act that would ban the federal government from owning more than 50 percent of any land in a state. The land would be transferred to the state -- or sold "to the highest bidder," as the liberal media watchdog group Think Progress puts it.
That could devastate parks, forests and monuments in Nevada, Utah, Idaho, Oregon and Alaska.

If it wasn't a 501(c)(3), then what the heck was it?  
Were the people who spent on/donated to the golf outing deducting those donation(s) on their taxes, under the impression that it was a legit charity?
Was it an official Muskegon County entity/function/department?
If it was the latter, I suppose that explains why somebody with the records went ahead and responded to a FOIA request.
(If it wasn't a "county" account, then it wouldn't ordinarily fall under state FOIA laws).
But if this thing didn't have the 501 paperwork/trimmings, and if it wasn't an official county department/fund/function, then it has all the earmarks of a common "slush fund."
What wipes me out is this: Muskegon County has legal counsel, whose job it (presumably) would be to do the 501 paperwork if the county wanted to administer a charitable fund. 
Who decided it was cool to let this go un-filed for years?  
From the story it looks like they were advised to have counsel square things up -- who decided "no?"  
The guy using the money for his kids' college and gas money?"

Well, would-ja check this out -- I can't vouch for its authenticity, but it looks like it speaks to my question posted below; question being, if this wasn't an official "county" thing, why the heck would it turn over anything - at all - to somebody filing a FOIA request?  


[I wouldn't call this first-class legal work, by the way.  There are only two proper answers to a FOIA request -- a) turn over everything the law requires, if 's a qualifying public entity that's being queried; or  b) don't turn anything over, if it isn't.  Turning over some documents, and not others, is the "worst of all worlds," so to speak.]

Anyhow, if the letter at that link is to be believed, it looks like various people on the county's payroll believed it was a "county" thing -- some may have used official letterhead, worked on it while on payroll, blah blah.  But then when the county was sued under FOIA for records (again, if this letter is to be believed), why, then, here comes the county, with "muchos affidavitos" about how it's not an official "county" thing.  

Here's why it's relevant: allegedly taking money from a charity is one thing.  Allegedly taking money from an official county fund (whether charitable or not) is quite another.  Allegedly (or, admittedly) using county resources to raise money for an arguably-private charity (if the county doesn't approve/maintain/sponsor it) is yet a third thing.  

But allegedly using the mail and/or the telephones to raise money in the county's name, if it's not, in fact, a "county" deal, would be not just a fourth thing -- it could be a "federal" thing (tax implications aside).

Oh, and the second-worst piece of lawyering on full display here?  Letting your client talk directly to the cops.  However this goes, I do hope Mr. Roesler considers trying to get his fees back for that "oops."
